Terms and Conditions

Your Shipment

System build time can take 1-2 weeks so expected delivery time is approximately 2-4 weeks, though some systems ship within the week. All packages are shipped via UPS ground. We will email your tracking number when your system ships.

Shipping fees include handling and packing fees as well as postage costs. Packages are insured and require an adult signature at delivery.

Because of the build and testing time, it usually makes little sense to pay for express shipping, but if you have special needs, please contact us. Even with overnight air however, it may take up to a week to get your computer.

Availability

Mothership Custom Computers LLC only provides service to the 48 continental United States. Any orders from overseas are not accepted. If you are Alaska or Hawaii please contact us first, otherwise your purchase may be refunded or you may be assessed additional shipping charges.

Returns

There is a seven day return policy, effective from when you receive your shipment. Shipping however, does not go to us, and is not refundable. Returns must be in excellent condition--any damages will be deducted from the refund amount. All return shipments must be insured for the full price.

To make a return, please contact us for a return authorization number and further instructions.

Removal or alteration of a product's serial number or serial number sticker will automatically void your return policy. Products that are returned to Mothership Custom Computers with a missing, damaged or altered serial number will be refused RMA service and returned to you. Products missing UPC codes or serial numbers from the box or equipment are NOT returnable.

Physically damaged components CANNOT be returned back to Mothership Custom Computers. Physical damage includes (but is not limited to) improper handling and any other type of damage sustained by irregular use. The only acceptable damages are those that occur in shipping and are confirmed by the shipping company as being covered by shipping insurance.

All items returned for a refund may be assessed a 15% restocking fee. Many manufacturers offer additional factory coverage. With regard to such, you should contact the manufacturer of your item directly for information regarding eligibility and specific Terms and Conditions.

Returns: Software Components

Opened Retail or OEM software can only be returned for replacement, and replacement RMAs will only be honored if the returned software is defective or damaged. Retail Boxed software may only be returned for refund if the packaging is unopened and factory sealed. If the software has been opened or damaged you will be assessed the cost of the software that was included in your system (and we will mail the opened/damaged software back to you).

Sales Tax

Sales tax is only required for orders shipping to Florida.

Technical Support

Mothership Custom Computers offers only limited technical assistance. Please contact the manufacturers of your hardware directly for accurate answers to your technical questions. We provide minimal tech support by email and phone call-back only. All systems are well tested before being shipped. Our technical support is limited to areas of configuration by Mothership Custom Computers and any compatibility issues with other software must be handled by the makers of that software. We do not provide basic computer tutoring and our systems are meant for those experienced with Windows Vista and basic computer operation.

Warranty and Service Plan

Mothership Custom Computers offers a standard 60-day warranty from the time of invoice, which is upgradeable to a 1-year, 2-year, and 3-year extended warranty contracts that cover parts, labor, and shipping back to the customer in the event of a hardware failure during normal use. A Service Plan is available as an upgrade to the standard 60-day warranty and is not a warranty on parts. The Service Plan only covers labor and shipping back to the customer. Under the Service Plan the customer agrees to pay for any costs associated with part replacement. Warranty coverage does not include damage from abuse, neglect, physical damage, chemical damage, water or flood damage, fire, radiation, exposure to magnetism, electrical damage, or acts of God. Warranty on the hard drive does not cover data restoration.

 

Limitation of Liability

IN ALL CIRCUMSTANCES MOTHERSHIP CUSTOM COMPUTERS LLC'S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. MOTHERSHIP CUSTOM COMPUTERS SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. MOTHERSHIP CUSTOM COMPUTERS SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT MOTHERSHIP CUSTOM COMPUTERS HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

MOTEHRSHIP CUSTOM COMPUTERS IS NOT RESPONSIBLE FROM ANY DAMAGES THAT MAY OCCUR FROM THE USE OF THIS WEBSITE.

Warranties

PRODUCTS SOLD BY MOTHERSHIP CUSTOM COMPUTERS ARE NOT MANUFACTURED BY MOTHERSHIP CUSTOM COMPUTERS . THE PRODUCTS MAY, HOWEVER, BE COVERED BY EACH MANUFACTURER'S WARRANTY, SERVICE, AND SUPPORT POLICY (IF PRESENT). MOTHERSHIP CUSTOM COMPUTERS MAKES NO REPRESENTATION OR EXPRESS WARRANTY WITH RESPECT TO THE PRODUCT EXCEPT THOSE STATED IN THIS DOCUMENT.

ALL ITEMS SOLD THROUGH MOTHERSHIP CUSTOM COMPUTERS ARE SOLD "AS-IS" OR "WITH ALL FAULTS." THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THESE ITEMS IS WITH THE BUYER. SHOULD ANY OF THESE ITEMS PROVE DEFECTIVE, DO NOT FUNCTION, OR FUNCTION IMPROPERLY IN ANY WAY FOLLOWING THEIR PURCHASE, THE BUYER, AND NOT MOTHERSHIP CUSTOM COMPUTERS , ASSUMES THE ENTIRE COST OF ALL NECESSARY SERVICING OR REPAIR.

Governing Law and Jurisdiction

Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Mothership Custom Computers and Customer shall be governed by the laws of the State of Florida, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. Mothership Custom Computers and Customer consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of Florida, Alachua County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agree not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Mothership Custom Computers that is more than one year after the date of the applicable invoice.
